State of Maharashtra\u00a0<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2><ol><li><span style=\"font-weight: 400;\">This was being used by many complainants and businessmen to exploit the accused in cheque bounce cases by filing cases in multiple jurisdictions and very distant from the drawer\u2019s bank.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">The complainants were also planning and choosing to sent legal notices from where they wanted to file the case so that they can pre-plan the jurisdiction of the case. <\/span><\/li><li><span style=\"font-weight: 400;\">The SLP was granted leave as the issue was of public importance. The petition was filed as there was massive abuse of the law by the complainants as held in the <a href=\"https:\/\/fawyerz.in\/judgments\/banking-and-insurance-law\/k-bhaskaran-vs-sankaran-1999-case-summary\/\">K. Bhaskaran\u2019s case<\/a><\/span><b>\u00a0<\/b><\/li><li><span style=\"font-weight: 400;\">The Previous settled law by K. Bhaskaran\u2019s case was that a complaint u\/s 138 can be filed anywhere <\/span><span style=\"font-weight: 400;\">where any act related to the offence occurred.\u00a0\u00a0<\/span><\/li><\/ol><h2><span class=\"ez-toc-section\" id=\"Issues_framed\"><\/span><span style=\"color: #993300;\"><b>Issues framed<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Whether the complainant should have the discretion to file a complaint under Section 138 of the NI Act at any location where any act constituting the offense occurs?<\/span><\/li><\/ol><h2><span class=\"ez-toc-section\" id=\"Judgment_of_Dashrath_Rupsingh_Rathod_v_State_of_Maharashtra\"><\/span><span style=\"color: #993300;\"><b>Judgment of <\/b><\/span><span style=\"color: #993300;\"><b>Dashrath Rupsingh\u00a0 Rathod v. State of Maharashtra<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2><p><span style=\"font-weight: 400;\">The Hon\u2019ble Supreme Court analysed Section 138 of the NI Act along with Section 177-179 of the Code of Criminal Procedure that deals with the jurisdiction.<\/span><\/p><p><span style=\"font-weight: 400;\">The Court held that giving choice to the complainant in cheque bounce cases to decide the jurisdiction is harmful and<\/span> <span style=\"font-weight: 400;\">\u00a0Prosecution in such cases can, therefore, be launched against the drawer of the cheque only before the Court within whose jurisdiction the dishonour takes place except in situations where the offence of dishonour of the cheque punishable under <\/span><a href=\"https:\/\/indiankanoon.org\/doc\/1823824\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Section 138<\/span><\/a><span style=\"font-weight: 400;\"> is committed along with other offences in a single transaction <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">The Court while overturning the <a href=\"https:\/\/fawyerz.in\/judgments\/banking-and-insurance-law\/k-bhaskaran-vs-sankaran-1999-case-summary\/\">K. Bhaskaran\u2019s Case<\/a> held that:\u00a0<\/span><\/p><p><i><span style=\"font-weight: 400;\">\u201c&#8230;The unilateral acts of a complainant in presenting a cheque at a place of his choice or issuing a notice for payment of the dishonoured amount cannot in our view arm the complainant with the power to choose the place of trial. Suffice it to say, that not only on the Principles of Interpretation of Statutes but also the potential mischief which an erroneous interpretation can cause in terms of injustice and harassment to the accused the view taken in the Bhaskaran\u2019s case needs to be revisited as we have done in foregoing paragraphs.\u201d<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">This Judgment overturned the ratio of the <a href=\"https:\/\/fawyerz.in\/judgments\/banking-and-insurance-law\/k-bhaskaran-vs-sankaran-1999-case-summary\/\">K.
