Basu, Executive Chairman of Legal Aid Services, West Bengal, addressed a letter to the Chief Justice of India, highlighting custodial deaths and urging the Court to develop &#8220;custody jurisprudence,&#8221; formulate a compensation framework for victims&#8217; families, and ensure accountability.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recognizing the seriousness and frequency of complaints regarding custodial violence and deaths, the Court treated the letter as a writ petition.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Subsequently, in 1987, a letter from Shri Ashok Kumar Johri regarding a custodial death in Aligarh was also treated as a writ petition and consolidated with the existing matter.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Supreme Court took note of the rising number of custodial deaths, commonly referred to as &#8220;lock-up deaths,&#8221; across various states and observed the lack of an effective mechanism to address such cases. Consequently, notices were issued to all State Governments and the Law Commission of India, directing them to submit their responses.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In compliance with the Court\u2019s directives, affidavits were submitted by several State Governments, the Union Territory of Chandigarh, and the Law Commission of India.<\/span><\/li><\/ol><h2><span class=\"ez-toc-section\" id=\"Issues_framed\"><\/span><span style=\"color: #993300;\"><b>Issues framed<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Whether fundamental rights guaranteed under Article 21 of the Constitution of India were being violated in cases of custodial violence and deaths?<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Whether there was a necessity for the formulation of guidelines or requirements to address the problem of custodial violence and deaths?<\/span><\/li><\/ol><h2><span class=\"ez-toc-section\" id=\"Judgment_of_Shri_DK_Basu_Ashok_K_Johri_vs_State_of_West_Bengal_State_of_UP\"><\/span><span style=\"color: #993300;\"><b>Judgment of <\/b><\/span><span style=\"color: #993300;\"><b>Shri D.K. Basu, Ashok K. Johri vs State of West Bengal, State of U.P.<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2><p><span style=\"font-weight: 400;\">The Hon\u2019ble Supreme Court analysed Articles 20(3), 21, 22, 32, and 226 of the Constitution of India; Sections 41, 46, 49, 50, 56, 57, and 176 of the Criminal Procedure Code, 1973; the 113th Report of the Law Commission recommending Section 114-B in the Indian Evidence Act; Article 5 of the Universal Declaration of Human Rights; Article 9(5) of the ICCPR; jurisprudence from England, Ireland, Trinidad and Tobago, and New Zealand.<\/span><\/p><p><span style=\"font-weight: 400;\">The Court broadly interpreted Article 21 to include not only the right to life but also the right to live with dignity, encompassing freedom from torture and custodial violence, affirming that this right remains inviolable even upon arrest.<\/span><\/p><p><span style=\"font-weight: 400;\">The Court relied on Article 22 to formulate procedural safeguards for arrest and detention. While acknowledging existing statutory protections under the Cr.P.C., the Court found them inadequate to prevent custodial violence due to challenges in securing evidence and prosecuting officials. The Court issued guidelines to ensure transparency and accountability, establishing the principle of public law compensation for custodial deaths and violence. It held the State strictly liable for such violations without the defence of sovereign immunity, and emphasized compensation as a solace rather than a punitive measure.<\/span><\/p><p><span style=\"font-weight: 400;\">The Court held that custodial violence, including torture and death in police lock-ups, strikes at the Rule of Law and is a naked violation of human dignity and the fundamental right to life guaranteed under Article 21 of the Constitution of India.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">As preventive measures to combat custodial violence and to bring in transparency and accountability, the Court laid down the following requirements to be followed in all cases of arrest or detention until statutory provisions are made:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The\u00a0 police\u00a0 personnel\u00a0 carrying\u00a0 out\u00a0 the\u00a0 arrest\u00a0 and handling the\u00a0 interrogation\u00a0 of\u00a0 the\u00a0 arrestee\u00a0 should\u00a0 bear accurate, visible\u00a0 and clear\u00a0 identification and\u00a0 name\u00a0 togs with their\u00a0 designations. The particulars of all such police personnel who\u00a0 handle interrogation\u00a0 of the arrestee must be recorded in a register.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">That the\u00a0 police officer carrying out the arrest of the arrestee shall\u00a0 prepare a\u00a0 memo of\u00a0 arrest at\u00a0 the\u00a0 time\u00a0 of arrest a such memo shall be attested by atleast one witness. who may\u00a0 be either a member of the family of the arrestee or a respectable\u00a0 person of\u00a0 the locality from where the arrest is made. It shall also be counter signed by the arrestee and shall contain the time and date of arrest.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">A person who has been arrested or detained and is being held in\u00a0 custody in a police station or interrogation centre or other\u00a0 lock-up, shall\u00a0 be entitled\u00a0 to have one friend or relative or\u00a0 other person known to him or having interest in his welfare\u00a0 being informed, as soon as practicable, that he has been\u00a0 arrested and\u00a0 is being\u00a0 detained at the particular place, unless the attesting witness of the memo of arrest is himself such a friend or a relative of the arrestee.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The time, place of arrest and venue of custody of an arrestee must be notified by the police where the next friend relative of the lives outside\u00a0 the district or town through the legal Aid Organisation in the District and the police station of the area concerned telegraphically within a period of 8 to 12 hours after the arrest.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The person arrested must be made aware of this right to have someone informed of his arrest or detention as soon he is put under arrest or is detained.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">An entry must be made in the diary\u00a0 at the\u00a0 place of detention regarding\u00a0 the arrest\u00a0 of the\u00a0 person which\u00a0 shall also disclose\u00a0 the name\u00a0 of he next friend of the person who has been informed of the arrest an the names and particulars of the police officials in whose custody the arrestee is.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The arrestee\u00a0 should, where\u00a0 he so\u00a0 requests,\u00a0 be\u00a0 also examined at\u00a0 the time\u00a0 of his\u00a0 arrest and\u00a0 major\u00a0 and\u00a0 minor injuries, if\u00a0 any present\u00a0 on his\/her body, must be recorded at that\u00a0 time. The\u00a0 &#8220;Inspection Memo&#8221; must be signed both by the arrestee and the police officer effecting the arrest and its copy provided to the arrestee.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The arrestee should be subjected to medical examination by trained\u00a0 doctor every\u00a0 48 hours\u00a0 during his\u00a0 detention in custody by\u00a0 a\u00a0 doctor\u00a0 on\u00a0 the\u00a0 panel\u00a0 of\u00a0 approved\u00a0 doctors appointed by\u00a0 Director, Health\u00a0 Services\u00a0 of\u00a0 the\u00a0 concerned State or Union Territory.\u00a0 Director, Health Services should prepare such a penal for all Tehsils and Districts as well.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">Copies of\u00a0 all the\u00a0 documents\u00a0 including\u00a0 the\u00a0 memo\u00a0 of arrest, referred\u00a0 to above,\u00a0 should be\u00a0 sent to\u00a0 the\u00a0 illaqa Magistrate for his record.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">The arrestee may be permitted to meet his lawyer during interrogation, though not throughout the interrogation.<\/span><\/i><\/li><\/ul><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><i><span style=\"font-weight: 400;\">A\u00a0 police\u00a0 control\u00a0 room\u00a0 should\u00a0 be\u00a0 provided\u00a0 at\u00a0 all district and state headquarters, where information regarding the arrest and the place of custody of the arrestee shall be communicated by\u00a0 the officer\u00a0 causing the\u00a0 arrest, within 12 hours of effecting the arrest and at the police control room it should be displayed on a conspicuous notice board.\u201d<\/span><\/i><\/li><\/ul><p><i><\/i><span style=\"font-weight: 400;\">The guideline was later incorporated into the Code of Criminal Procedure (Amendment) Act, 2010, which played a significant role in regulating the concern of custodial violence.<\/span><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><\/p><h2><span class=\"ez-toc-section\"
