Subordinate Court Judgment

The trial court dismissed the claim of the plaintiff. Consequently, being aggrieved by the trial court’s order of dismissal, a revision application was preferred by the Plaintiff at the Hon’ble Allahabad High Court.

Judgment of Lalman Shukla v Gauri Dutta

The Allahabad High Court applied principles of contract law, specifically the necessity of an offer and its acceptance to form a binding agreement. It examined the requirements of knowledge of the offer and intention to accept the terms as prerequisites for a valid contract.

The Allahabad High Court held that Lalman Shukla could not claim the reward as he was unaware of the offer at the time he performed the act of finding the boy. The decision clarified that a contract cannot exist without mutual agreement and intention, and knowledge of the offer is crucial to establish acceptance.

The Allahabad High Court ruled in favor of Gauri Dutta, stating that there was no contract between the parties regarding the reward.
